Instructions for law enforcement requests to EZVIZ

EZVIZ shall cooperate with government agencies in law enforcement within the limitation of applicable laws and regulations. This article aims to explain the acceptance methods, conditions, and processing processes for law enforcement requests, for a clearer understanding of EZVIZ's practices, so as to improve the efficiency of our collaboration.

This article is applicable to government cooperation in jurisdictions other than Chinese Mainland. If you find that your jurisdiction has different legal requirements than those in this article, please do not hesitate to inform EZVIZ.

Please note that the data EZVIZ can provide is strictly limited to which referred to in EZVIZ Transparency Report; meanwhile, your request will be recorded and made public on the EZVIZ official website as statistical data of EZVIZ Transparency Report.

Receiving addresses

Government requests shall be sent from official address of relevant government agencies, accompanied by valid certificates, to the following address of EZVIZ

Requests that have not been delivered to the above address, such as those sent to customer service email, may not be processed immediately due to circulation needs.

Legal Basis

In order for us to quickly make response, the government agencies making legal requests shall state specific laws and regulations upon which their requests are based, and issue the requests in strict accordance with applicable laws and regulations. Relevant applicable laws and regulations include but not limited to EU General Data Protection Regulation, EU Digital Services Act, etc.

Emergency

EZVIZ will treat the request as an emergency if it is related to a situation involving an urgent and serious threat to personal life/security, national security, or the security of critical infrastructure/installations. EZVIZ will review any requests on an urgent basis if the requesting government agency can prove that their requests involve the aforementioned situations.

Request for Account Disposal instead of data providing

If a government agency requests EZVIZ to restrict or delete any account of an user, EZVIZ will require a court order or other equivalent legal instrument (including an injunction, conviction verdict or writ) to prove that such account was used in a way illegal or infringing others’ legitimate rights. If EZVIZ determines that the request does not have a valid legal basis, or if the government agency cannot prove illegal use or infringement of such account, EZVIZ will deny or challenge the request. If EZVIZ receives a qualified court order or other equivalent legal instrument from the government or law enforcement agency, which can prove that the account requested to be restricted or deleted has been illegally used or infringes others’ legitimate rights, EZVIZ will comply with such order or equivalent legal instrument, to take necessary steps to restrict or delete the account, while informing the requesting agency of the process.

User Notifications

When EZVIZ provides users’ data in response to legitimate and valid requests from government agencies, EZVIZ will notify these users as soon as possible, except for the following circumstances: court orders received by EZVIZ and applicable law expressly prohibit the provision of notification; EZVIZ believes that providing notification would pose a risk of injury or death to an identifiable individual or groups; the cases involve child abuse; or, the notification does not apply to the basic facts of the case.

If EZVIZ receives any court order requiring a confidentiality period, EZVIZ will provide a notice after the confidentiality period specified in the court order expires, unless EZVIZ believes that providing notification may bring a risk of harm or death to an identifiable individual or group, or the case involves child abuse, or the notification does not apply to the basic facts of the case.

If EZVIZ receives a court order proving that the account requested to be restricted/deleted has been used illegally or infringes others’ legitimate rights, EZVIZ will notify the user when it restricts or deletes the relevant account accordingly , unless the following circumstances exist: the legal proceeding itself, a court order received by EZVIZ, or applicable law prohibits the provision of notification; the case involves child abuse; EZVIZ has reason to believe that providing notification will expose an identifiable individual or group to a risk of injury or death; the notice does not apply to the underlying facts of the case.

Rights Reserved

If EZVIZ believes that any request lacks a legitimate and reasonable legal basis, that any request is unclear, inappropriate or too broad, or that it may harm the legitimate interests of any third party, EZVIZ shall be entitled to object, question or reject such request.

Unless there are special requirements under applicable laws and legal documents, EZVIZ only provides remote assistance without appearing in person, especially in jurisdictions where we have not established branches.

EZVIZ reserve the right to charge reasonable fees incurred by any government agency for complying with its lawful requests.

1. This form shall be used by the government requiring disclosure of information on the basis of the applicable laws or regulations. Government or government agency herein refers to administrative authorities, judiciary authorities and law enforcement agencies.

2. No fields for requiring information should be left blank in general. If the information requested is not available or not applicable, please indicate “not available” or “not applicable” in the form. Any omission of required information in this form could cause delays in the processing of the request.

3. Once the form is completed, it should be mailed to EZVIZ with the correct receiving addresses and “GOVERNMENT REQUEST” or “GOVERNMENT REQUEST FOR EMERGENCY” (if request is for any emergency) should be included in the subject line of the mail.
